We may use this information for website operation, security, troubleshooting, analytics and improvement.

5. Sources of Personal Information

Because of the nature of process serving and litigation support, CAN-WEST frequently receives personal information from someone other than the individual to whom the information relates.

6. Why We Collect, Use and Disclose Personal Information

7. Consent and Other Lawful Authority

Where consent is required by applicable privacy legislation, CAN-WEST will seek consent appropriate to the circumstances. Consent may be express or implied where permitted by law and may be provided by an individual or an authorized representative.

However, the nature of process serving and litigation support means that CAN-WEST may collect, use or disclose personal information without the knowledge or consent of the individual where permitted or required by applicable law.

  • where the collection, use or disclosure is related to an investigation or legal proceeding and the applicable statutory requirements are satisfied;
  • where it concerns information that is publicly available as defined or prescribed by applicable legislation;
  • where it is necessary to comply with a subpoena, warrant, court order or other lawful requirement;
  • where it is required or authorized by law; necessary for debt collection or related purposes permitted by law; required in an emergency and permitted by law;
  • where it relates to investigating a breach of an agreement or contravention of law and the statutory requirements are satisfied; or
  • where it is otherwise permitted without consent under applicable privacy legislation.

Nothing in this Privacy Policy expands CAN-WEST’s authority to collect, use or disclose personal information beyond what applicable law permits. Where our handling of information depends upon consent, an individual may withdraw consent subject to reasonable notice and any applicable legal, contractual or other restrictions.

8. Persons Being Served

A person who is the subject of a process-serving assignment will often not have provided their personal information directly to CAN-WEST and may not have consented to being contacted. We generally receive information required to perform an assignment from a client, lawyer, law firm, litigant, legal document, court record or other lawful source.

  • identify the intended recipient; locate the person to be served; determine whether an address or location is current; distinguish the intended recipient from another person; attempt or complete service; document the circumstances of an attempted or completed service; report the results of an assignment to our client; and prepare evidence of service for use in legal proceedings.

We seek to limit our collection and use to information reasonably required for the assignment or otherwise permitted by law.

9. Disclosure of Personal Information

CAN-WEST does not sell personal information.

We may disclose personal information where reasonably necessary for the purposes described in this Privacy Policy, with consent where required, or where otherwise permitted or required by law.

  • the client who retained CAN-WEST; lawyers and law firms; courts and court registries; process servers; court agents; investigators and search providers; subcontractors and other agents; commissioners for oaths and notaries; printing, copying and document-production providers; courier and delivery providers; technology, hosting and cloud-service providers; payment processors and financial institutions; accountants, auditors, insurers and professional advisers; collection agencies; government, regulatory and law-enforcement authorities where authorized or required by law; parties involved in an actual or proposed business transaction where permitted by law; and other persons where permitted or required by applicable law.

CAN-WEST seeks to limit disclosures to information reasonably necessary for the applicable purpose.

10. Process Servers, Agents and Service Providers

CAN-WEST may engage independent process servers, court agents, investigators, contractors and other service providers to complete assignments. Personal information provided to such persons will, where reasonably practicable, be limited to information necessary to perform the assignment or service.

Depending upon the circumstances, a service provider may process information on CAN-WEST’s behalf or may have independent legal obligations regarding personal information in its custody or control. We use reasonable contractual, administrative or other safeguards appropriate to the circumstances when personal information is handled on our behalf.

11. Interprovincial and International Processing

CAN-WEST operates in Alberta, Saskatchewan, British Columbia and Manitoba and regularly provides services involving more than one jurisdiction. Personal information may therefore be transferred between provinces when completing an assignment.

We may also use cloud computing, communications, hosting, payment or other technology providers that process or store information in another province or outside Canada. Where personal information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, governments, regulatory bodies or law-enforcement authorities in accordance with applicable law.

CAN-WEST uses reasonable measures appropriate to the circumstances to protect personal information processed by service providers. Individuals may contact our Privacy Officer for additional information concerning our policies regarding service providers outside Canada.

12. Accuracy

CAN-WEST makes reasonable efforts to ensure personal information under its control is as accurate, complete and current as reasonably necessary for the purposes for which it is used. The nature of process serving and skip tracing means that information supplied by clients, public sources or third parties may sometimes be historical, incomplete or inaccurate. Where appropriate, CAN-WEST may seek to verify information through additional lawful sources.

13. Safeguarding Personal Information

CAN-WEST recognizes that information associated with litigation and process serving may be sensitive. We use physical, administrative and technical safeguards appropriate to the sensitivity of the information and the risks associated with its handling.

  • access controls; password and authentication requirements; secure electronic transmission where appropriate; device and network security; secure electronic or cloud storage; physical protection of paper records; limiting access to personnel requiring information to perform their duties; confidentiality obligations; employee and contractor privacy practices; secure document disposal; data backup and recovery procedures; and security and incident-response procedures.

No electronic transmission or storage system is completely secure. CAN-WEST therefore cannot guarantee absolute security. Clients should exercise appropriate care when transmitting sensitive information by ordinary email or other unsecured electronic communications.

14. Privacy and Security Breaches

CAN-WEST maintains procedures intended to identify, investigate, contain and respond to suspected or confirmed breaches involving personal information. Where a breach occurs, we will assess its circumstances and take reasonable steps appropriate to the nature and severity of the incident.

Where required by applicable privacy legislation, CAN-WEST will report the breach to the appropriate privacy regulator and notify affected individuals. CAN-WEST will maintain records of privacy breaches where required by applicable law.

15. Retention and Destruction

CAN-WEST retains personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected and to meet applicable legal, contractual and business requirements.

  • the nature of the assignment; court and procedural requirements; limitation periods; contractual requirements; accounting and taxation obligations; regulatory or statutory requirements; actual or potential disputes and claims; and the nature and sensitivity of the information.

When personal information is no longer reasonably required, CAN-WEST will securely destroy, delete or anonymize it in accordance with our retention practices, subject to applicable legal requirements. Information contained in system backups may remain for a limited period until deleted or overwritten through normal backup processes.

16. Access to Personal Information

Subject to applicable law, an individual may request access to personal information about them under CAN-WEST’s control and information concerning how that information has been used or disclosed. Requests should be submitted in writing to our Privacy Officer.

  • verify the requester’s identity; locate the requested information; and determine the scope of the request.

The right of access is not absolute. Applicable privacy legislation may require or permit CAN-WEST to refuse access to certain information. Depending upon the circumstances, access may be restricted where disclosure would reveal personal information concerning another person, confidential commercial information, privileged information, information whose disclosure could threaten another person’s safety, or other information that applicable law permits or requires us to withhold.

CAN-WEST will respond within the time prescribed by the privacy legislation applicable to the request and will provide information concerning any applicable extension, refusal, fee or recourse rights as required by law.

17. Correction of Personal Information

An individual who believes personal information under CAN-WEST’s control is inaccurate or incomplete may request that it be corrected. Where appropriate and required by applicable law, we will correct the information. Where we do not agree that a requested correction should be made, we will address the request as required by applicable legislation.

18. Legal Proceedings, Privilege and Access Restrictions

Information under CAN-WEST’s control may relate to existing or contemplated litigation, investigations, privileged communications or evidence. Nothing in this Privacy Policy requires CAN-WEST to provide access to information where access may or must be refused under applicable law.

Where reasonably necessary, CAN-WEST may consult with the client who retained us, legal counsel, a government institution or another appropriate person to determine our legal obligations concerning an access or correction request.

19. Website, Cookies and Analytics

CAN-WEST’s website may use cookies and similar technologies for website functionality, security, preferences and analytics. Depending upon our website configuration, these technologies may include essential cookies required for website operation, security technologies, preference cookies, and analytics technologies used to understand website usage and improve performance.

Users may control certain cookies through their browser settings. Disabling cookies may affect website functionality. Where CAN-WEST implements technologies requiring additional notice or consent under applicable law, appropriate notice and choices will be provided.

20. Electronic Submission of Documents

Where CAN-WEST permits clients to submit service instructions, court documents or other information electronically, the materials may contain confidential and personal information. Information submitted to us will be used for purposes associated with the requested service and otherwise handled in accordance with this Privacy Policy.

Clients are responsible for ensuring that they have lawful authority to provide documents and personal information to CAN-WEST.

21. Payment Information

Where CAN-WEST accepts electronic payments, payment transactions may be processed by third-party payment processors or financial institutions. CAN-WEST may receive information concerning the transaction without receiving or retaining complete payment-card information where the information is submitted directly to the payment provider.

A third-party payment provider’s processing of personal information may also be governed by its own privacy policy.

22. Third-Party Websites

Our website may contain links to websites, portals or online services operated independently of CAN-WEST. CAN-WEST is not responsible for the privacy or security practices of independent third parties. Users should review the applicable third party’s privacy policy before providing personal information.

23. Questions and Privacy Complaints

CAN-WEST takes privacy concerns seriously. Questions, concerns or complaints concerning our handling of personal information should be directed to the Privacy Officer using the contact information in Section 26.

CAN-WEST will investigate and respond to privacy complaints as required by applicable law. If a concern cannot be resolved directly with CAN-WEST, an individual may have the right to make a complaint to the privacy regulator having jurisdiction, including, where applicable:

  • the Office of the Privacy Commissioner of Canada for matters governed by PIPEDA;
  • the Office of the Information and Privacy Commissioner of Alberta for matters governed by Alberta PIPA; or
  • the Office of the Information and Privacy Commissioner for British Columbia for matters governed by BC PIPA.

24. Changes to this Privacy Policy

CAN-WEST may amend this Privacy Policy periodically to reflect changes in our services, business practices, technology or applicable law. The current version will be published at https://canwps.com/ and will identify its effective or last-updated date. Where a change is material, CAN-WEST may provide additional notice where appropriate or required by law.

25. Interpretation

This Privacy Policy describes CAN-WEST’s privacy practices and is not intended to create rights beyond those provided by applicable law. If there is any inconsistency between this Privacy Policy and applicable privacy legislation, the applicable legislation will govern.

The privacy legislation applicable to a particular matter may depend upon the circumstances, including the province in which the collection, use or disclosure occurs, the nature of the organization or information involved and whether personal information is transferred across provincial or national borders.
